The maximum sentence that can be imposed will vary according to the court in which the case is prosecuted. Cases that are prosecuted in the Sheriff Court summary level (where a Sheriff sits without a jury), the maximum sentence is 12 months imprisonment.
In Sheriff Court Solemn Proceedings (where a sheriff sits with a jury), the maximum sentence is 5 years imprisonment, and for very serious cases prosecuted in the High Court the sentence is unlimited.
